Terms of use of the artafon.com shop.

Terms and Conditions of the artafon.com online shop

Version 2026-10-27, effective from 2026-10-27.

These Terms and Conditions set out the rules for shopping at artafon.com and for using the services on the website: the account, the newsletter and the forms. In them, “we” means the seller and “you” means the person who buys or uses the website.

Contents:

  4. We do not charge for contacting us. You only pay your phone or internet provider according to its price list.
  5. We are also the manufacturer of the products sold in the Shop.

Section 2. Definitions

In these Terms and Conditions, the following words have this meaning:

  • Shop - the online shop at www.artafon.com in its Polish, English and German versions.
  • Customer (you) - a person who buys in the Shop or uses the services on its website. A Customer may be a consumer, a sole trader with consumer rights or a business customer.
  • Consumer - a natural person who buys for a purpose not directly connected with their business or professional activity.
  • Sole trader with consumer rights - a natural person running a business who buys in connection with that business, but for whom the purchase is not of a professional nature (Section 16).
  • Business customer - a Customer who buys as part of their business or professional activity and is not a sole trader with consumer rights.
  • Partner - a business customer to whom we have given an account in the Shop with partner prices (Section 17).
  • Account - your account in the Shop, which you sign in to with a password or with Google.
  • Product - an item you can buy in the Shop.
  • Kit - a product made up of several other products of the Shop, sold together; its contents are shown on the product page.
  • Order - a purchase of selected products that you place at checkout using the “Order and pay” button.
  • Working days - Monday to Friday, except statutory public holidays in Poland.

Section 3. General rules, languages and technical requirements

  1. These Terms and Conditions are both the terms of sale and the terms for the provision of services by electronic means. We make them available free of charge on the Terms and Conditions page - you can print them or save them on your device at any time. After you place an order, you also receive them by e-mail, in the version in force on the day of the order.
  2. The Shop and these Terms and Conditions are available in three languages: Polish, English and German. You can conclude a contract with us in any of them. The language of the contract is the language of the version of the Shop in which you place your order, sign in for the first time or subscribe to the newsletter. If the language versions of these Terms and Conditions differ from one another, the version in the language in which we concluded the contract is binding.
  3. To use the Shop, you need a device with internet access, an up-to-date web browser and an e-mail address. To place an order, sign in and send forms, your browser must have JavaScript and cookies enabled.
  4. Using the internet involves typical risks, such as messages pretending to come from well-known companies (phishing) or malicious software. We never ask by e-mail or phone for your account password or payment card details - online payments take place on the payment providers' websites. Do not give your password or the code from an e-mail to anyone. On someone else's device, sign out when you have finished shopping.
  5. We do not apply any codes of good practice or codes of ethics. We do not adjust prices individually on the basis of automated decision-making.

Section 4. Electronic services

  1. On the Shop's website, we provide the following electronic services free of charge:
    • browsing the Shop, including the search and the garage, which matches products to your bike (without an account, the garage is saved only in your browser);
    • the cart and the checkout, where you place your order;
    • the account (Section 5);
    • the newsletter (Section 6);
    • a one-off e-mail asking for your opinion about your purchase on Google, sent only with your consent (point 6);
    • the contact form and the withdrawal form.
  2. A contract for a one-off service - browsing the Shop, using the cart, sending a form - is concluded when you start using it. It ends when you stop using it or when you send the form. We keep the cart of a Customer without an account for 60 days from the last change.
  3. The account contract and the newsletter contract are concluded for an indefinite period. The rules for terminating them are set out in Section 5 and Section 6.
  4. When using the Shop, you must not:
    • send unlawful content, including content that infringes the rights of others, is offensive or is misleading - this applies in particular to forms and order notes;
    • send unsolicited commercial information through the Shop or give someone else's e-mail address without its owner's consent;
    • disrupt the operation of the website, for example by automatically flooding forms, getting around security measures or introducing malicious software.
  5. To protect the Shop and Customers from abuse, we limit how many times certain actions can be performed within a given time, for example placing orders, signing in with a password, requesting confirmation codes and sending forms. If you see a message saying that a limit has been exceeded, try again later or write to us.
  6. We send an e-mail asking for your opinion about your purchase on Google (a review request) only with your consent. You give it when placing an order, by ticking a separate, optional box at checkout, which is not ticked in advance. Consent is voluntary and is not a condition of purchase: without it, you place and receive your order on the same terms. By giving it, you conclude a free-of-charge contract with us for this service. The contract ends when we send the message, when you withdraw your consent or once it is clear that we will not send the message (for example after the order is cancelled). The rules:
    • we send at most one such message per order, no earlier than 10 days after we dispatch the parcel or hand over the order on collection in person, and we do not send reminders about it;
    • we do not send it while a complaint or another matter concerning the order is open, and if the order has been cancelled or refunded, or you have withdrawn from the contract, we do not send it at all;
    • leaving a review is voluntary and its content is entirely up to you; you post the review on Google, under Google's terms; we do not offer discounts, codes or any other benefits for a review;
    • you can withdraw your consent at any time, free of charge and without giving a reason: using the opt-out link in that message or by writing to us at contact@artafon.com; after that, we will no longer send review requests to that e-mail address. Withdrawing your consent does not affect your orders.
    We process the data as described in the Privacy Policy.

Section 5. Account

  1. You create an account on the Account page or at checkout: you enter your e-mail address, receive a one-time code at that address, enter it on the website and set a password (at least 8 characters). The code is valid for 10 minutes. You can also sign in with Google – then the account is created the first time you do so. You set a new password the same way, with a one-time code from an e-mail.
  2. When you create an account or sign in for the first time, you accept these Terms and Conditions and conclude the account contract with us. The contract is free of charge. Accounts transferred from the old shop become usable once the Terms and Conditions are accepted – see Section 21.
  3. You do not need an account to shop - you can buy without signing in. When you sign in with an e-mail address that you previously used for orders without an account, you will see those orders in your account.
  4. In your account you can: view your orders and order the same products again, save addresses (up to 20) and invoice details, keep a garage (up to 5 bikes) and a list of favourite products (up to 200). Favourites only work when you are signed in.
  5. You stay signed in on a given device for up to 180 days, unless you sign out earlier. You can change the e-mail address of your account by writing to us.
  6. You can delete your account at any time using the “Delete account” button in your account details or by asking us to do so by e-mail. This terminates the account contract with immediate effect. We delete or anonymise the personal data from the account. We keep orders that have been placed for as long as the law requires (details in the Privacy Policy), and the link in the confirmation e-mail still leads to each of them.
  7. We may terminate the account contract:
    • with 14 days' notice, if we stop running the Shop or the account service - we will send you the notice by e-mail;
    • with immediate effect, if you continue to break the prohibitions in Section 4 despite our request.
    Termination of the account contract does not affect orders placed earlier.

Section 6. Newsletter

  1. You subscribe to the newsletter by entering your e-mail address in the field in the page footer. We will send you a message with a link. Your subscription only becomes active once you confirm it with the button on the page that this link leads to. The newsletter contract is free of charge.
  2. In the newsletter, we send information about new products and offers in the Shop. Subscribing is not a condition of purchase.
  3. You can unsubscribe at any time - by clicking the unsubscribe link in every issue of the newsletter or by writing to us. Unsubscribing is free of charge and ends the contract.
  4. We may stop sending the newsletter. We will let subscribers know about this at least 14 days in advance.
  5. We use an external tool to send the newsletter. The details of data processing are set out in the Privacy Policy.

Section 7. Complaints about electronic services

  1. If an electronic service (for example the account, signing in, the newsletter or a form) does not work as described in these Terms and Conditions, you can make a complaint: by e-mail to contact@artafon.com, using the contact form with the subject “Complaints”, or by letter to the address in Section 1.
  2. Describe what happened and when, and give the address to which we should reply. This will make it easier for us to respond.
  3. We respond to a complaint within 14 days of receiving it, by e-mail or by letter.
  4. Complaints about products are covered in Section 15.

Section 8. Products, prices and currencies

  1. The description, photos and technical data of each product are on its page in the Shop.
  2. Prices in the Shop are gross prices, which means they include VAT. For delivery to Australia and Canada, the price does not include Polish VAT - in that case, the checkout shows it without this tax. Prices for Partners are covered in Section 17.
  3. The price of a product does not include the cost of delivery. You see the cost of delivery and the total amount to pay at checkout before you place your order.
  4. The price at the moment you place the order applies. If the price changes while you are placing the order, the checkout will show the new amounts and ask you to confirm again.
  5. Whenever we reduce a price, we also show the lowest price of the product in the 30 days before the reduction.
  6. You can view prices in Polish złoty (PLN), euro (EUR), pounds sterling (GBP) and US dollars (USD) - you choose the currency in the page footer. We convert amounts in currencies other than PLN at the Shop's exchange rate.
  7. You pay in the currency in which you view the prices: Polish złoty (PLN), euro (EUR), pounds sterling (GBP) or US dollars (USD). Not every payment method is available in every currency - the checkout only shows those you can pay with. The checkout always shows the currency and the amount to pay, and we record the Shop's exchange rate from the time of the order in the order.

Section 9. Discount codes

  1. You enter a discount code in the cart or at checkout. You can use one code per order. The discount applies to products, not to the cost of delivery. A code cannot be exchanged for money. Discount codes are not available to Partners.
  2. The amount of the discount, the period of validity and any exclusions are stated in the announcement of the given code.
  3. The welcome code for creating an account:
    • you can see it on your account page when you are signed in;
    • it only works when you are signed in to your account - if you enter it without signing in, it stays in the cart and will work once you sign in;
    • you can use it once per e-mail address;
    • it does not cover products on promotion (with a reduced price) - we calculate the discount on the other products in the cart, and if the cart contains only products on promotion, the code will not work.
  4. We treat a code as used when you place an order with it. If that order is cancelled or - in the case of payment in advance - is not paid within 14 days of being placed, you can use the code again.
  5. If you withdraw from the contract with respect to some of the products bought with a code, we refund the amount actually paid for them, that is, after deducting the part of the discount attributable to them.

Section 10. Ordering step by step

  1. You can place orders 24 hours a day, 7 days a week. We fulfil them on working days.
  2. This is how you place an order:
    1. You add products to the cart (up to 99 units of one product and up to 50 different items). The cart is not yet an order.
    2. You go to the checkout. You buy without signing in by giving your e-mail address, or you sign in with a code sent by e-mail.
    3. You fill in the successive sections of the checkout: Contact, Delivery (country and address, or collection in person), Sales document (Receipt or Invoice) and Payment. You can add notes to your order.
    4. You review the summary: the products, the total price including taxes, the cost and time of delivery, the payment method, the payment currency, information about the right of withdrawal and our details.
    5. You tick the box accepting the Terms and Conditions. If you wish, you also tick the separate box consenting to a review request (Section 4).
    6. You click the “Order and pay” button.
  3. Until you click the button, you can correct all the data: change the form fields, go back to the cart, change quantities, the delivery method and the payment method. The checkout validates the data (for example the format of the e-mail address, postcode, phone number and NIP), points out fields that need correcting, and recalculates the summary after every change.
  4. The sales contract is concluded at the moment you click the “Order and pay” button and the Shop accepts the order and gives it a number. Clicking the button means that you undertake to pay.
  5. Immediately afterwards, we send a confirmation of the conclusion of the contract to your e-mail address. It contains the content of the order, information about the right of withdrawal, the model withdrawal form and these Terms and Conditions as an attachment - in the version in force on the day of the order. Keep this message: it records the content of the contract. You can also open the order at any time via the link in this message and, when signed in, in your account.
  6. If you have not received the confirmation (also look in your spam folder), write to us.
  7. You cannot cancel an order yourself on the website. If you want to change something or cancel, write to us as soon as possible. Until we have dispatched the parcel or handed over the order, we will, where possible, change or cancel it and refund your payment. A consumer and a sole trader with consumer rights (Section 16) can also withdraw from the contract under the rules in Section 14.

Section 11. Payments

The checkout only shows the payment methods available for your order. They depend on the delivery country, the delivery method, the payment currency and the type of account. We do not charge any fee for choosing a payment method - the only exception is the cash on delivery surcharge added to the cost of delivery.

Przelewy24 - BLIK, online bank transfer, card. You pay in PLN on the website of the payment provider Przelewy24, where you choose BLIK, online bank transfer or payment card.

PayPal. You pay in PLN, EUR, GBP or USD on the PayPal website.

Payment card or Revolut Pay. You pay in PLN, EUR, GBP or USD on the Revolut payment page - by payment card or with Revolut Pay. This page may also offer Apple Pay or Google Pay if your device supports them.

Bank transfer. You pay in PLN or EUR by standard bank transfer. We give the transfer details - the recipient, the account number (for EUR also the SWIFT code), the amount and the payment reference, which is the order number - on the order page and in the confirmation e-mail.

Cash on delivery. Only for courier delivery in Poland and in PLN. You pay the courier when you receive the parcel. We add a cash on delivery surcharge to the cost of delivery, which you see at checkout before placing the order.

Pay on collection. Only for collection in person in Katowice and in PLN. You pay when you collect the order.

Bank transfer, 14-day terms (invoice). Only for Partners from Poland and in PLN. You pay by bank transfer within 14 days of the invoice date.

We accept payment in advance (Przelewy24, PayPal, payment card or Revolut Pay, bank transfer) for 14 days from when the order is placed. If an online payment did not go through, during this time you can try again on the order page, including with a different payment-in-advance method. We fulfil an order paid in advance once the payment has been credited.

If an order with online payment (Przelewy24, PayPal, payment card or Revolut Pay) is not paid, we may send you at most two payment reminders by e-mail. These are service messages about the order you have placed, without advertising: they show the order number, the amount, the contents of the order and the date by which you can still pay, and they lead to the order page where you can complete the payment. You can pay for the order until 14 days have passed since it was placed. We do not send reminders once the order has been paid or cancelled.

If you do not pay on time, we may set you an additional deadline for payment by e-mail and, if that deadline also passes without payment, withdraw from the contract. Within the additional deadline you can pay by standard bank transfer; we will give you the transfer details in that e-mail. We will inform you of the withdrawal by e-mail.

Online payments are handled by payment providers. We do not know or store your card details.

We refund money (for example after an order is cancelled or after withdrawal from the contract) using the same method that was used for payment, unless you expressly agree to a different method that is free of charge for you. For cash on delivery or payment on collection in person, we will refund the money by bank transfer to the account you give us.

Section 12. Delivery and collection in person

  1. We ship by courier to the countries you can choose at checkout: to Poland, to most European Union countries and to selected countries outside the Union (including the United Kingdom, the United States, Canada and Australia). You will see the current list of countries, delivery costs and delivery times at checkout, before you place the order; general information about delivery is on the Delivery page. The cost and delivery time shown at checkout at the moment you place the order apply.
  2. We dispatch the parcel within 1–3 working days: for payment in advance - from when the payment is credited, and for cash on delivery and bank transfer with 14-day terms - from when the order is placed. On top of this comes the transit time shown at checkout for the selected country. When we dispatch the parcel, we will send you an e-mail with the tracking number.
  3. Collection in person is possible if you choose Poland as the delivery country. It is free of charge and takes place in Katowice at ul. Asnyka 32 d, on working days, 8–16 Polish time. Preparing the order usually takes 1–3 working days. Come and collect it once you receive an e-mail from us saying that it is ready for collection.
  4. If you are a consumer and we do not deliver the product on time, you can set us an additional deadline and, if that deadline passes without effect, withdraw from the contract. You can withdraw from the contract without setting an additional deadline if we have refused to deliver the product or if the delivery date was essential for you, as follows from the contract or the circumstances in which it was concluded.
  5. For delivery outside the European Union, the recipient may have to pay customs duty, import tax and customs clearance fees charged by the customs office or the carrier. They are not part of the price in the Shop, and we do not collect them.
  6. If the parcel is visibly damaged, we ask you - if possible - to examine it in the presence of the courier and to draw up a damage report with the courier. This will make it easier for us to settle the matter with the carrier. This is a request, not a condition: the lack of a report does not limit your rights described in Section 14 and Section 15.
  7. If you are a consumer, the risk of accidental loss of or damage to the product passes to you only when the parcel is handed over to you or to a person you have designated. The rules for business customers are in Section 17.
  8. Give your exact address and phone number. If the parcel comes back to us because it could not be delivered, we will write to you to agree on the next steps.

Section 13. Receipt and invoice

  1. At checkout, you choose the sales document: a receipt or an invoice. A Partner always receives an invoice.
  2. For an invoice, you give the company name, the address and the NIP (buyer from Poland) or - if you wish - the VAT number (buyer from another country). We issue a Partner's invoice to the company details saved in their account; you can change them by writing to us. If you buy privately and need an invoice, write to us and we will issue it in your name. Choose a company invoice at checkout: we cannot issue one later for a receipt without a NIP.
  3. Check your invoice details before you place your order. If you notice an error in them, write to us.
  4. We issue and deliver invoices in accordance with the invoicing regulations - to businesses from Poland also via the Polish National e-Invoice System (Krajowy System e-Faktur) where the regulations require this.

Section 14. Withdrawal from the contract

  1. If you are a consumer or a sole trader with consumer rights (Section 16), you can withdraw from the contract within 14 days without giving any reason.
  2. The period runs from the day on which you, or a person other than the carrier designated by you, acquire physical possession of the product. If the order arrived in several parcels - from the day on which you receive the last of them. You can also withdraw from the contract before you receive the product.
  3. To withdraw from the contract, send us an unequivocal statement before the period expires, for example:
    • using the online form on the Withdrawal from contract page - the “Withdraw from contract here” link is in the footer of every page of the Shop;
    • by e-mail to contact@artafon.com;
    • by letter to ul. Asnyka 32 d, 40-696 Katowice, Poland.
  4. You can use the model withdrawal form - it is also in the order confirmation e-mail - but you do not have to. To meet the deadline, it is enough to send your statement before the period expires.
  5. We will confirm receipt of your statement by e-mail without undue delay. The online form sends such a confirmation immediately.
  6. Send the product back to ul. Asnyka 32 d, 40-696 Katowice, Poland no later than 14 days from the day on which you withdrew from the contract. It is enough to send it before this period expires. You bear the direct cost of returning the product. Please do not send the return cash on delivery, and pack the product so that it is not damaged in transit. You will find practical tips on the Returns page.
  7. We will refund all payments to you, including the cost of delivering the product to you, without undue delay and no later than 14 days from the day on which we receive your statement. If you choose a delivery method more expensive than the least expensive standard delivery method we offer, we do not refund the additional costs connected with it. The rules for refunds are set out in Section 11. We do not receive customs duty or import taxes charged in the delivery country, so we cannot refund them - you can claim them back from your country's customs authority if the rules of your country allow this. If you send the product back from a country outside the European Union, mark the parcel as returned goods.
  8. We may withhold the refund until we receive the product back or proof that it has been sent back, whichever happens first.
  9. You can familiarise yourself with the product as you would in a physical shop. You are only liable for any diminished value of the product resulting from using it in a way that goes beyond what is necessary to establish its nature, characteristics and functioning.
  10. Once you withdraw, the contract is deemed not to have been concluded.
  11. Business customers do not have the right of withdrawal (Section 17).

Section 15. Lack of conformity of the product with the contract (complaints)

  1. We are obliged to deliver a product that is in conformity with the contract. If you are a consumer or a sole trader with consumer rights, we are liable for any lack of conformity of the product with the contract that existed at the time of delivery and became apparent within two years of that time. A lack of conformity that becomes apparent within those two years is presumed to have existed at the time of delivery, unless we prove otherwise. These rules derive from Article 43a and the following articles of the Polish Consumer Rights Act of 30 May 2014 (ustawa o prawach konsumenta).
  2. If the product is not in conformity with the contract, you can demand that it be repaired or replaced. We may replace the product instead of repairing it, or repair it instead of replacing it, if the method you have chosen is impossible or would require excessive costs on our part. If both repair and replacement are impossible or would require excessive costs, we may refuse to bring the product into conformity with the contract.
  3. We carry out the repair or replacement within a reasonable time and without excessive inconvenience to you. We bear its costs, including shipping costs. We collect the product for repair or replacement from you at our expense - write to us and we will agree how to do this. If the product was fitted before the lack of conformity became apparent, we remove it and fit it again after the repair or replacement, or have this done at our expense. You do not pay us for normal use of a product that we subsequently replace.
  4. You can make a statement that you are reducing the price or withdrawing from the contract if:
    • we have refused repair and replacement or have not carried them out as described in point 3;
    • the lack of conformity persists even though we have tried to bring the product into conformity with the contract;
    • the lack of conformity is so significant that it justifies a price reduction or withdrawal from the contract straight away;
    • it is clear from our statement or from the circumstances that we will not bring the product into conformity with the contract within a reasonable time or without excessive inconvenience to you.
  5. You cannot withdraw from the contract if the lack of conformity is insignificant - however, it is presumed to be significant. Once you withdraw, send the product back to us at our expense. We will refund the price within 14 days of receiving the product or proof that it has been sent back. We will refund the amount due after a price reduction within 14 days of receiving your statement.
  6. Until we fulfil the obligations described in points 2–5, you may withhold payment of the price.
  7. You can make a complaint by e-mail to contact@artafon.com, using the contact form with the subject “Complaints”, or by letter to ul. Asnyka 32 d, 40-696 Katowice, Poland. Please give the order number or date, a description of the problem, what you are requesting (repair, replacement, price reduction or withdrawal from the contract) and your contact details; photos also help. These make things easier, but they are not conditions for your complaint to be considered.
  8. We respond to a complaint within 14 days of receiving it, by e-mail or on paper. If you are a consumer or a sole trader with consumer rights and we do not respond within this period, we are deemed to have accepted the complaint.
  9. We do not give any additional guarantee for the products. Your rights derive from the statutory provisions described in this Section. You will find fitting instructions on the Instructions page.
  10. Complaints from business customers are covered in Section 17.

Section 16. Sole trader with consumer rights

  1. This Section applies to a natural person who runs a business and concludes a contract with us that is directly connected with that business, where the content of the contract shows that it is not of a professional nature for that person. Whether it is of a professional nature is determined in particular by the type of business activity entered in CEIDG (Article 7aa of the Consumer Rights Act). Example: the owner of a renovation company buys a motorcycle guard for the company - the purchase is connected with the business, but motorcycles are not the owner's professional speciality.
  2. Such a person has the same rights with us as a consumer with regard to withdrawal from the contract (Section 14), lack of conformity of the product with the contract (Section 15) and protection against unfair contract terms. Section 17 does not apply to them.
  3. If the contract does not make it clear whether the purchase is of a professional nature for you, you can make a statement about this no later than when the contract is concluded, for example in the order notes or in an e-mail sent before you place the order. We do not make the sale conditional on such a statement.
  4. Giving a NIP for the invoice does not in itself determine that the purchase is of a professional nature for you.

Section 17. Business customers and Partners

  1. This Section applies only to business customers within the meaning of Section 2. It does not apply to consumers or to sole traders with consumer rights.
  2. A business customer does not have the statutory right to withdraw from a distance contract. A product can only be returned by agreement with us.
  3. In relation to business customers, we exclude liability under the statutory warranty for defects (rękojmia za wady; Article 558 of the Polish Civil Code, Kodeks cywilny). The exclusion does not apply if we have fraudulently concealed the defect, nor to the extent that the law does not allow it. If you notice a defect, write to us - we will consider each report individually.
  4. The risk of accidental loss of or damage to the product passes to the business customer when we hand the parcel over to the carrier.
  5. A Partner is a business customer to whom, at their request, we have given an account with partner prices. We set up and change such accounts manually - write to us. We may change or revoke Partner status, for example if the VAT number ceases to be valid or if we end our cooperation. We will inform you about this by e-mail.
  6. A Partner from Poland sees net prices and pays them plus 23% VAT. They order for delivery in Poland, and courier delivery and collection in person are free of charge for them. They can also pay by bank transfer within 14 days of the invoice date (Section 11).
  7. A Partner from another country sees net prices and pays them without VAT (0% rate - intra-Community supply of goods within the European Union or export outside the Union). The condition is a VAT number that we have verified (for companies from the Union - in the VIES system). Until the number has been verified, the account shows the Shop's standard prices. A Partner from another country orders for delivery outside Poland.
  8. A Partner does not benefit from promotions or discount codes and does not buy kits. We always issue a Partner's invoice to the company details in their account.

Section 18. Out-of-court dispute resolution

  1. If you are a consumer, you can use out-of-court methods of dealing with complaints and pursuing claims. Taking part in such proceedings is voluntary. If we do not uphold your complaint, we will state in our reply whether we agree to out-of-court proceedings.
  2. You can get free help and information from, among others:
    • the consumer helpline (infolinia konsumencka): 801 440 220 or 222 66 76 76 (on working days);
    • a municipal or district consumer ombudsman (miejski lub powiatowy rzecznik konsumentów);
    • the regional inspectorate of the Trade Inspection (wojewódzki inspektorat Inspekcji Handlowej), which helps to settle a dispute amicably or through a permanent consumer arbitration court (stały polubowny sąd konsumencki).
  3. You will find information about the institutions that conduct out-of-court proceedings on the website of the Polish Office of Competition and Consumer Protection (Urząd Ochrony Konkurencji i Konsumentów): polubowne.uokik.gov.pl.
  4. If you live in another country of the European Union, in Iceland or in Norway, the network of European Consumer Centres can help you in a dispute with us - in Poland: konsument.gov.pl.

Section 19. Governing law and courts

  1. Contracts concluded by the Shop are governed by Polish law. The United Nations Convention on Contracts for the International Sale of Goods of 11 April 1980 (CISG) does not apply to contracts with business customers.
  2. If you are a consumer and live in a country other than Poland, the choice of Polish law does not deprive you of the protection given to you by the laws of the country of your habitual residence where those laws cannot be excluded by agreement (Article 6(2) of Regulation (EC) No 593/2008 - Rome I).
  3. Disputes with consumers and sole traders with consumer rights are settled by the court having jurisdiction under the general rules. Disputes with business customers are settled by the court having jurisdiction for our place of business.

Section 20. Changes to the Terms and Conditions

  1. We may change these Terms and Conditions only for an important reason, that is, if:
    • the laws that apply to the Shop or to the content of these Terms and Conditions change;
    • a decision or ruling of a competent authority or court requires us to do so;
    • we change the scope or manner of providing electronic services - we add a new function or remove an existing one;
    • we change the payment methods, the delivery methods or their providers;
    • our details change, such as our name, address or e-mail address;
    • it becomes necessary to improve the security of the Shop or to prevent abuse;
    • it becomes necessary to remove obvious errors or ambiguities or to align the language versions of these Terms and Conditions.
  2. We give notice of a change at least 14 days before it takes effect: on the Shop's website and, for account holders and newsletter subscribers, also by e-mail.
  3. If you do not accept the changes, you can, before they take effect, delete your account or unsubscribe from the newsletter free of charge (Section 5, Section 6).
  4. A change to these Terms and Conditions does not apply to sales contracts concluded earlier. To those contracts, we apply the version of the Terms and Conditions from the day of the order, attached to the order confirmation. On request, we will send you any earlier version.

Section 21. Final provisions

  1. The rules for processing personal data and for cookies are set out in the Privacy Policy.
  2. These Terms and Conditions do not exclude or limit any rights of a consumer or of a sole trader with consumer rights that cannot be excluded or limited by contract. If any provision of these Terms and Conditions conflicts with those rights, we apply the statutory provisions.
  3. In matters not covered by these Terms and Conditions, we apply Polish law, in particular the Civil Code, the Consumer Rights Act and the Polish Act on Providing Services by Electronic Means (ustawa o świadczeniu usług drogą elektroniczną), subject to Section 19.
  4. If you have an account from our previous artafon.com online shop, we have transferred it to this Shop. You can use such an account only after you accept these Terms and Conditions; we will ask you to do so when you first sign in. We will record the date of acceptance, the version of the Terms and Conditions and the language version that was displayed. Until you accept, the account is blocked: you can sign out and buy without an account, or delete the account free of charge (Section 5). Orders placed in this Shop are subject to these Terms and Conditions immediately.
  5. Send any questions about these Terms and Conditions to contact@artafon.com.
